JUDGMENT 1. 1. This appeal is filed aggrieved by the order dated 21.5.97 passed by the Family Court, Ajmer in suit No. 2/9 of by which order, the Family Court directed the defendants in the suit (respondents herein) to pay Rs. 1,000/- per month to the appellant as maintenance from the date of order. The appellant is the plaintiff in the said suit. The respondents 1 to 4 are her sons. The appellant claimed maintenance @ Rs. 3,000/- per month. After hearing the learned counsel for the parties on the last date of hearing and having regard to all the aspects we thought it appropriate to direct the respondents to be present before the Court so that the dispute can be resolved amicably in view of the close relationship between the parties and that too taking note of the fact that the respondents 1 to 4 are fortunately well placed. Pursuant to our directions, respondents 2 and 3 are present in the Court. Respondent No. 1 is said to be not well. Respondent 4 is living at Suratgarh. The respondents 2 and 3, who are present in the Court submitted that they have no objection to pay the maintenance to their mother @ Rs.2,000/- per month, while adding that they are ready to take their mother to live with them and because of her brother there are some problems. They also further submitted that they have the consent of their brothers respondents 1 and 4 to make submissions. The learned counsel for the respondents based on the instructions and as submitted by the respondents 2 and 3 stated that the order may be passed awarding the maintenance Rs. 2,000/- per month to the appellant. The learned counsel for the appellant is satisfied with the submission made by the learned counsel for the respondent for awarding Rs. 2,000/- as maintenance to the appellant per month. He also submitted that he has instructions from the appellant to accept this offer. 2. In the light of the above submissions of the learned counsel for the parties we deem it unnecessary to consider the various submissions raised by the parties on merits of the case. In this view, we proceed to pass the following orders - (i) The respondents 1 to 4 shall pay a sum of Rs. 2000/- per month towards maintenance to the appellant (each of them Rs.
In this view, we proceed to pass the following orders - (i) The respondents 1 to 4 shall pay a sum of Rs. 2000/- per month towards maintenance to the appellant (each of them Rs. 500/- per month to make up Rs. 2,000/-). This amount of Rs. 2,000/- per month shall be paid from August, 1999. (ii) As regards the maintenance from May 1997, till the end of July 1999, the respondents 1 to 4 shall deposit Rs. 25,000/- (equally sharing) in fixed deposit in the name of the appellant for a period of three years in the first instance in a Nationalised Bank at Ajmer within a period of one month from today. The Bank concerned shall pay interest accrued on that fixed deposit to the appellant once in three months. The fixed deposit so made shall not be withdrawn by any of the parties without further orders of this Court. 3. In view of the orders passed above, the appeal stands disposed of.Appeal disposed of accordingly. *******
