JUDGMENT 1. - Mr. Maheshwri states that Truck No. PB-10X-9779 had for the first time entered in Rajasthan on 23.3.99 and at the most tax, if at all payable, is or one quarter from January to March. He states that the petitioners are appeared to deposit the amount of tax under protest. 2. Mr. Kothari states that the respondent has no objection to the release of the truck if the petitioners deposit tax for one quartet and furnishes security. 3. Having considered the submissions, it is directed that the truck No. PB-10X-9779 may be released to the petitioners on the following conditions : (i) that petitioner No. 2 shall furnish a Supardaginama in the sum of Rupees five lacs with a solvent surety in the like amount to the satisfaction of Special Mobile Magistrate and Judicial Magistrate, Chhattisgarh; (ii) that petitioner no. 2 shall produce the said truck during the enquiry or trial of the case or as and when called upon to do so by the Special Mobil Magistrate and Judicial Magistrate, Chhattisgarh or any other court; (iii) that petitioner No. 2 shall not make any alteration in the body of the truck. He will not change the colour of the truck and shall (MATTER MISSING) same condition as it is delivered to him. If any alteration is needed then he shall seek prior permission of the aforesaid court; (iv) that petitioner No. 2 shall not transfer or otherwise dispose of the aforesaid truck till the matter is finally adjudicated; and (v) that the petitioner No. 2 shall deposit the tax for one quarter. 4. If any of the aforesaid condition (i) to (iv) is violated by the petitioners then it will be open for the learned Public Prosecutor/the District Transport Officer to make an application before the Special Mobile Magistrate and Judicial Magistrate, Chittorgarh to get back the aforesaid truck from the petitioner and the Magistrate shall decide the application after hearing all the concerned parties without reference to this Court 5. This petition is disposed of as indicated above.Petition disposed of accordingly. *******
