JUDGMENT 1. - In view of Full Bench judgment of this Court in Bharat Bhushan v. State of Rajasthan and others, reported in 1985 R.L.R. page 974 the petitioner State of Rajasthan has to first approach the Board of Revenue by way of review petition for reviewing its impugned order. 2. In view of the above, earned counsel Mr. Hemant Chaudhary for the State seeks permission to withdraw this petition with liberty to file review petition before the Board of Revenue. Permission granted. 3. Disposed of as withdrawn, at this stage. 4. At this stage, a request is made by learned counsel Mr. Hemant to Chaudhary that the Board of Revenue be directed to entertain the review petition on merits as by now the same would be time barred. Learned counsel for the respondent states that he has no objection if the Board of Revenue decides the review petition on merits after condoning the delay in filing the review petition late. 5. In view of the above discussion, the Board of Revenue is directed to entertain and decide the review filed by the petitioner State within two months from today. 6. With these observations, this petition is disposed of as withdrawn.Revision disposed of. *******
