JUDGMENT 1. - Heard. 2. It is alleged that on 25.5.99 the applicant cut the branches of the trees, which were sworn by the complainant in his field. Regarding the occurrence the complainant filed his complaint in the court on 3.7.99. On such complaint, having been forwarded under Section 156(3) Cr.PC. to the police for investigation, Crime No. 285/99 stands registered against the applicant at P/S. Neem Ka Thana, Sikar, for offences under Sections 323, 441, 389, 504 IPC. 3. I have looked into the case diary. The land in question appears to have been recorded as `Bajar' in Samvat year 2055. The complaint itself was filed after about two months of the alleged occurrence. in the site map the Investigating Officer does not appear to have found any evidence of cutting the trees or taking the clay from the field, which is alleged to be in possession of the complainant. 4. Looking to the facts and circumstances of the case it is directed that in the event of their arrest the applicants Rahmatullah, Nizamuddin and Islamuddin, all sons of Shri Chand Khan, and Shankerlal S/o. Murarilal, shall be released on bail on their furnishing two sureties in the amount of Rs. 5,000/- each with personal bond in the amount of Rs. 10,000/- to the satisfaction of the officer arresting them and they shall observe the following conditions : (i) that the person(s) shall make himself/themselves available for interrogation by a police officer as and when required; (ii) that the person(s) shall not, directly or indirectly make any inducement, threat or premise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; (iii) that the person(s) shall not leave India without the previous permission of the court. 5. This order shall remain in force till the expiry of one month after the submission of the charge sheet, if any against him/her/them during the meanwhile the applicant(s) may appear before the court concerned and pray for regular bail there.Bail Granted. *******
