JUDGMENT 1. - In this appeal, the accused-appellants have been convicted under section 201 IPC and sentenced to four years R.I. with a fine of Rs. 200/- and in default to undergo one month simple imprisonment. 2. Counsel for the appellants has asserted that the testimony of the witnesses produced at trial does not prove that the deceased died a violent death. There is no evidence on record to establish that there was any unnaturality in the death of the deceased, in as much as all the accused persons along with the father of the deceased were in the meeting and without any resistance being offered by the father of the deceased, the body of the deceased was cremated and till that point of time no suspicion was shown that the deceased has died a violent death. If the deceased had not died an unnatural death, then it cannot be said that any offence has been committed by the accused-appellants. For bringing home the conviction under section 201 IPC, the worth requisite is that it should be proved beyond all reasonable doubt that an offence has been committed. This ingredient is missing as far as the present case is concerned. Another ingredient which is required is that the accused-appellants had the knowledge of the incident. If these two ingredients are missing then it cannot be said that the accused had causing dis-appearance of the evidence of offence or pointed to give any false evidence in this regard. 3. The learned Public Prosecutor has not been able to refute the arguments advanced by the learned counsel for the appellants. In this background, the conviction and sentence of the accused-appellants cannot be maintained under section 201 IPC. Consequently, the conviction and sentences awarded against the accused-appellants are set-aside and the accused-appellants are acquitted of the charges levelled against them. All the accused-appellants except Bhura are on bail. There bail bonds are hereby cancelled. Accused-appellant-Bhura be also released forthwith if he is not required in any other case.Appeal allowed. *******
