Honble MITAL, J.–This is second bail petition by petitioner Asha Ram in Sessions Case No. 32/99 pending in the court of learned Additional Sessions Judge, Ratangarh. Besides other grounds, the petitioner has also sought to be released on bail on the ground that his mother has died on 24.10.99 and the petitioner being only son has to perform all the final rites. A photo stat copy of the certificate to this effect has been produced in the bail petition and the original has been shown to me. It is contended that the petitioner may be released on humanitarian ground and the bail petition may be kept pending to be considered on other grounds on merits. The learned Public Prosecutor, in view of the above circumstances, do not seriously oppose the bail petition for interim bail. (2). In these circumstances, the petitioner is granted interim bail for a period of twenty days from today, provided he furnishes a personal bound in the sum of Rs. 10,000/- ( Rs. Ten thousand ) and one surety in the like amount to the satisfaction of the trial court for his appearance in the court on all the dates fixed for hearing of the case and to surrender to the court after the expiry of the said period to be sent to judicial custody again. A copy of this order be sent to the trial court immediately. The petitioner shall not give any threat, inducement or promise to the witnesses of this case. (3). Put up the case for hearing for regular bail on merits on 10.11.99.
