JUDGMENT : 1. Learned counsel appearing for the appellant has relied upon a decision of this Court by two learned Judges in the case of Dakaya v. Anjani, (1995) 6 SCC 500 , in support of his case. 2. Learned counsel appearing for the respondent asserts that in this case the explanation to Section 10(2)(i) of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960 has extended to the provision of Section 10 of A.P. Buildings (Lease, Rent & Eviction) Control Act, 1960 which is legally not permissible. This argument prima facie has some substance. We, therefore, feel that this matter may be heard by a Bench of three Judge. The Office is directed to place the file of this case before Hon'ble the Chief Justice of India for appropriate orders.
