(1) THIS application has been filed by M/s. Bengal Cable Industries alleging therein that the industry is "F" category and not "H" category and therefore there should be no obstruction for its continuing. (2) THE learned counsel appearing for the Delhi Pollution Control Committee ( D.P.C.C.) states that no doubt, the industry is category "F", but it is a non-conforming zone and necessary permission of the competent authority has not been obtained and, therefore, question of permitting the industry to continue does not arise. (3) IN view of this state of affairs, while accepting the prayer of the applicant that the industry is category "F", we direct that the said industry before running must obtain necessary permission/consent from the competent authority and if such an application is filed, the appropriate authority should apply its mind to the activities of the industry to the zone in which the same is running and dispose of the same in accordance with law. (4) THE I.A. stands disposed of accordingly. LA. No. 1996/99 (5) MR. Das, appearing for the applicant seeks to withdraw this application saying that he will move the D.P.C.C. for its consent to run the industry in question and on such an application being filed, the D.P.C.C. shall consider the same and pass appropriate orders in accordance with law. Therefore, the question of issuing any direction by this court does not arise. (6) IT is stated by the counsel appearing for D.P.C.C. that the activities of the applicant does not come within "H" category, but, at the same time, no industry can be allowed to run until and unless it obtains the necessary consent from the D.P.C.C. This I.A. is accordingly dismissed as withdrawn.
