JUDGMENT : R.K. Dash, J. - This is an application for cancellation of bail granted to opposite parties 1 to 4 by the learned Additional Sessions Judge, Kendrapara. 2. Petitioner's grievance is that conditions imposed by the Court while admitting the aforesaid opposite parties to bail having been violated, he moved an application for cancellation of bail in the very same Court through the Public Prosecutor. But to his utter surprise his application was dismissed as withdrawn on the basis of a memorandum filed by the public Prosecutor. Hence he has approached this Court by filing the present Criminal Misc. Case. 3. From the order, Annexure-2 it appears that a memorandum was filed by the public Prosecutor intimating the Court that he did not want to proceed with the case and on the basis of the said memorandum, the Petitioners' application was dismissed as withdrawn. The action of the Public Prosecutor in withdrawing the application is highly deprecated. Since the move was made by the Petitioner for cancellation of bail, he ought not to have withdrawn the same. In my opinion, he betrayed the trust reposed on him. If the very same Advocate is continuing as Public Prosecutor, it is left open to the State Government to take appropriate decision as to if for the interest of the State he will be allowed to continue. Send a copy of this order to the Law Department. 4. Coming to the grievance of the Petitioner, since evidence is required to be taken to find whether conditions imposed by the learned Additional Sessions Judge were violated, the Petitioner, if advised, may approach the very same Court. 5. With the above observation, the Criminal Misc. Case is disposed of.
