Honble SHETHNA, J.–The petitioner has prayed in this petition that the respondents be directed to carry out the voting in the meeting dated 23.2.1999 for consideration of motion of no confidence against the Chair Person and Deputy Chair Person, Zila Parishad, Udaipur by way of secret ballot only. (2). Learned counsel Shri Maheshwari for the petitioner relying upon the pro- vision of Section 37(8) of the Rajasthan Panchayati Act, 1994 and submitted that for the reasons stated in the petition it is desirable that the respondents should be directed to carry out the voting by secret ballot only. (3). Section 37(8) of the Act, 1994 reads as under:- ``37(8) : Such debate shall automatically terminate on the expiration of two hours from the time appointed for the commencement of the meeting, if it is not concluded earlier. On the conclusion of the debate or on the expiration of the said period of two hours, whichever is earlier, the motion shall be put to vote. (4). It no where provides that voting should be done by secret ballots only. It only provides that the motion shall be put to vote. It may be either by raising of hands or by secret ballots, if it is asked for and the Chair Person presiding over the meeting is satisfied for giving secret ballots. Thus, normal course is to have the voting by raising of hands and not by secret ballots. It is only in exceptional cases the secret ballots can be provided by the competent authority presiding over the meeting on a request being made, otherwise not. (5). It appears that with a view to challenge the proceedings of no confidence motion in future, the petitioner has filed this petition so that in future he can urge that he had earlier filed petition for secret ballots and in the meeting secret ballots were not granted, therefore, failure of `no confidence motion was challenged. Such type of petitions are at premature stage which cannot be entertained by this Court. (6). If such petitions are entertained then it will open the flood gates and every person would file petition and seek secret ballots when no confidence is brought. It appears that petitioner wants that `no confidence motion is passed at any cost for which this Court cannot be a party to it. (7). Under the circumstances, this petition fails and is hereby dismissed.
