A.S.GODARA, SHIVARAJ V.PATIL

body1999
JUDGMENT 1. 1. Heard the learned counsel for the appellant. The appellants filed S.B. Civil Writ Petition No. 1676/98 challenging the Advertisement Annexure/3 dated 10.3.97 and Annexure P/4 dated nil inviting applications in the open competition for appointments. The learned Single Judge by the impugned order in this writ appeal dismissed it on the ground that the selections were made for appointment after issuing notice inviting applications as per Annexures P/3 and P/4 which provide fair opportunity to all eligible candidates. The only contention that the selection should be made only through man power roster and not by inviting applications did not find favour with the learned Single Judge. 2. Before us the learned counsel for the appellants reiterated the very submission that was made before the learned Single Judge. The learned counsel stated that the Man power Department maintains a roster and that would have been followed otherwise there was no need to continue with roster. 3. We have considered the submission of the learned counsel for the appellants. Annexures P/3 and P/4 impugned in the writ petition are consistent with the law laid down by the Supreme Court. The learned Single Judge took note of the fact that opportunity was given to all eligible candidates by inviting applications by advertisement. In vour view, no fault can be found with the order of the learned Single Judge. Whether the State Government should continue such roster in the Man Power Department or not is matter to be examined in appropriate case. This being the position we do pot find any good reason to admit this appeal. 4. The appeal is, therefore, dismissed.Appeal Dismissed. *******
