JUDGMENT 1. -This misc. petition is filed by the complainant seeking direction to the Investigating Officer to complete investigation in FIR No. 92/93 P.S. Parbatsar. 2. The learned Public Prosecutor points out that challan has already been filed against 12 persons on 5.9.1998 under sections 148, 149 & 307 IPC and one accused named in the FIR has expired. He further points out that the investigation is going on against the remaining 6 accused persons in respect of whom incomplete charge- sheet has been filed. 3. A perusal of the case diary shows that the six accused, who were granted anticipatory hail, have not appeared before the Investigating Officer, and therefore, investigation has not been completed. If it is so, it is the duty of the Investigating Officer to approach the Court concerned for cancellation of the bail granted to the accused. In any case, investigation should be completed within reasonable time. 4. The petition is disposed of with directions to the investigating officer to complete the investigating within three months and submit a report under section 173, Cr.P.C. before the Magistrate concerned. If for some reasons beyond the control of the Investigating Officer, investigation is not completed, the Investigating Officer shall request the concerned Magistrate to extend the time for completing the investigation, who shall pass appropriate orders.Petition disposed of. *******
