The subject matter involved in this writ petition for adjudication pertains to appointment on compassionate ground. 2. Admittedly, the matter of appointment of the petitioner Smti Runa Das was considered at the appropriate level and thereafter the Director of Education, BAG, Kokrajhar, the competent authority, directed the District Elementary Education Officer, Barpeta, to appoint the petitioner whenever any vacancy arose. The above direction was issued as far back as on 23.8.96. 3. A mere request from a superior officer/authority is a command on the subordinate authority. No justifiable reason is furnished to this Court for not complying with the order of the Director of Education, BAG, Kokrajhar issued vide DE/BAC/Misc.176/96/103 dated 23rd August, 1996 for so many years. The respondents, more particularly the respondent No.2, the District Elementary Education Officer, Barpeta, is to comply with the order of the Director, as aforesaid, and appoint the petitioner against any available vacancy in any elementary school under its jurisdiction in conformity with the order of the Director, within three months from the date of receipt of certified copy of this order. 4. The writ petition stands accordingly allowed. No order as to costs.
