JUDGMENT 1. - This appeal is directed against the judgment dated 22.11.1982 passed by the learned Sessions Judge. Chum, convicting the appellant for the offence under Section 376 IPC and sentencing him to three and half years' rigorous imprisonment 2. It is alleged that on 21.7.81, the accused appellant committed rape on Mst. Chanda wife of Ramniwas, Smt. Chanda appeared in the witness box as PW 4. The learned trial court relying on the testimony of the prosecutrix Chanda and the other witnesses convicted and sentenced the accused as stated above. 3. I have heard learned counsel for the parties and carefully perused the to record. I have also gone through the statement of Mst. Chanda. I find her statement to be natural and trustworthy, In view of this. I do not find any infirmity In the judgment convicting the appellant for the offence under Section 376 IPC. 4. It is contended by the learned counsel appearing for the appellant that appellant has already undergone a sentence of one and half years and, is therefore, his sentence may be reduced to the period already undergone. It also appears that even after the bail was granted by this Court. The appellant remained in jail in connection with some other offence. 5. Considering all the facts and circumstances of the case, the ends of justice would be met if the sentence awarded to the accused appellant is reduced to the period already undergone. 6. Consequently, with the modification on the point of sentence as indicated above i.e. reducing the sentence to the period already undergone, the conviction of the appellant for the offence under section 376 IPC is maintained and the appeal stands dismissed.Appeal partly allowed - Sentence reduced as above. *******
