JUDGMENT Looking to the case diary prima facie it appears that the incident in question had taken place on 31.12.1998 at about 7.30 p.m. Three persons, namely; Brijmohan, Haricharan and Jitendrasingh alias Chantki (applicant) had gone to the house of the deceased, Ramvirsingh husband of Smt. Ramdevi and there they had picked up quarrel and exchange of abuses had taken place. Afterwards, it appears that two of the aforesaid three accused persons fired katta at the deceased, Ramvirsingh. The applicant, Jitendrasingh alias Chantki does not prima facie appear to have played any active role in the incident in question. He was simply present there along with the other accused persons, namely; Brijmohan and Haricharan. Under these circumstances, particularly keeping in mind the role played by this applicant, I am of the considered view that it is feasible to allow this application and it is accordingly allowed. The applicant, Jitendrasingh alias Chantki shall be enlarged on bail if he furnishes personal bond to the tune of Rs. 30,000/- with two solvent sureties of Rs. 15,000/- cash to the satisfaction of CJM, Morena.
