JUDGMENT Heard. Perused the case diary. The incident of the alleged rape is said to have taken place on 30.1.1999 at 6.30 p.m. and the first information report is alleged to have been lodged the next day at 9.30 a.m. by the prosecutrix Harnambai. In the first information report, it prima facie appears that she named two accused persons namely 8hma and Roopsingh and the name of the applicant Kalla alias Gangaram does not find place in the first information report. Surprisingly, name of the applicant finds place in the police statement of the prosecutrix Harnambai, which was recorded later on. Learned counsel for the applicant submits that in fact, applicant's name was falsely roped in on account of previous enmity, between him and the husband of the prosecutrix, regarding which some FIR under section 324 IPC was lodged by Amarsingh, husband of the prosecutrix. Under these circumstances, I find it is feasible to allow this bail application. It is accordingly allowed and it is ordered that if the applicant furnishes a personal bond in the tune of Rs. 20,000/- with two sureties of the like amount, to the satisfaction of the Chief Judicial Magistrate, Vidisha, he shall be released on bail. After release, he shall appear before the Court concerned on the date fixed and on other future dates. Certified copy as per rules.
