ORDER The petitioner has filed this writ petition for quashing the order dated 28.3.1994, annexure 1, whereby the petition of the petitioner for grant of freedom fighter pension has been rejected. The claim of the petitioner is that he was absconding during the freedom movement. He filed a petition for grant of freedom fighter pension annexing the relevant documents on 26.8.1992. An enquiry was made with regard to genuineness of the claim of the petitioner and after enquiry matter was placed before the Freedom Fighter Division under the Union of India. The said petition was rejected vide Annexure 1 on flimsy ground. A counter affidavit has been filed stating therein that unless the authority is satisfied freedom fighter pension cannot be granted. The authority was not satisfied with regard to the claim of the petitioner and as such the petition of the petitioner has been rejected vide annexure 1. It is evident from the material on record that the reason assigned for rejection of the claim of the petitioner is that G.R. Case No. 846 of 1942 was instituted and copy of the same has been obtained in the year 1987. Learned counsel for the petitioner says that the reason assigned is not tenable. There is substance in the submission of the learned counsel for the petitioner. Certified copy of the document can be obtained at any time but the same cannot be ground for rejection of the claim. Accordingly, this application is allowed. The order, annexure 1, is set aside. The respondent concerned is directed to consider the claim of the petitioner afresh and dispose of the same by a reasoned order in accordance with law within a period of four months from the date of receipt/production of a copy of this order.
