JUDGMENT 1. - Heard, the learned counsel for the accused petitioner. The matter is being finally heard and decided in view of the consent of the learned counsel for the parties. 2. The case was registered against the accused petitioner in pursuance to the FIR No 16/1995 for the offences under Sections 307, 327, 384, 324, 452, 323 read with Section 34 IPC. During the course of hearing it has been stated by the learned counsel for the petitioner that he has not been permitted to cross-examine P.W. 1 Ishwar Das, injured, PW. 14 - Jagdish Prasad, I.O. and P.W. 16 Dr. K.C. Gupta. This fact is also born out from the impugned order of the trial court dated 23rd March, 1999. 3. Keeping in view, the facts and circumstances of the case and also that the interest of justice may not suffer, prima facie I am of the view that in this case, the accused should have been given sufficient opportunity of cross examining the witnesses not only but also to lead evidence in rebuttal in case he so desires. The only request which has been made during the course of hearing is that the petitioner be permitted to cross-examine the aforesaid witnesses and if opportunity is given learned counsel for petitioner shall complete the cross examination within shortest possible time. The trial court, i.e. the Addl. Sessions Judge No. 1, Jaipur City, is there more, directed to permit the petitioner to cross-examine the aforesaid witnesses P.W. Ishwar Das, P.W. 14 Jagdish Prasad, and P.W. 16 Dr K.C. Gupta, within six weeks w.e.f. 24th April, 1999. The witnesses shall be summoned by the trial court for the purpose of cross-examination by the learned counsel for the petitioners. 4. As the result of the above discussions, the revision petition is allowed and the impugned order dated March 23, 1999 passed by the Addl. Sessions Judge, No. 1, Jaipur City, in Sessions Case No 16/1995 is, quashed and set aside. The petitioner is directed to appear before the trial court on the date fixed i.e. on 14th May, 1999.Revision allowed. *******
