ORDER T.N. Vallinayagam, J.—This civil revision petition is filed by a poor litigant who is unaware of the procedures and out of whom Petitioner Nos. 4 to 7 are minors. The wife of the 1st Petitioner and mother of Petitioners 2 to 7 died in an accident. Normally, in the case of compensation for death, the insurance company should automatically come forward to settle the claim through the Lok Adalat. But unfortunately, that was not done in this case. On the other hand, the insurance company is only interested in opposing the claim at every point of time. 2. It is true that there has been default on the part of the Petitioners in prosecuting the claim petition, but they were successfully kept away from the compensation for a long period of 11 years as on date. The accident occurred in 1987. It is certainly a pitiable position where any human being except the insurance company would have come forward to settle and satisfy the person who suffered on account of the death of the victim, Smt. Nanjamma. 3. It is extremely unfortunate that even before this Court, the revision petition is very stoutly opposed by the insurance company. In my view, in matters such as this, social justice should prevail. When a woman's life is already taken away by the cruel hands of death, the compensation which is normally payable by the owner of the vehicle cannot be stopped by the insurance company who stands as the intermediary or agent of the owner. It is worthwhile to note that the owner is not before the Court, nor is he opposing payment of compensation due to the Petitioners. 4. In this view, I have no hesitation to allow the petition and condone the delay and restore the main Miscellaneous Case No. 38 of 1988 on file, directing the trial Court to proceed with the matter and dispose of the same within a period of six months from the date of receipt of a certified copy of this order. Even now, I appeal to the insurance company to settle the matter through the Lok Adalat so that the deceased soul may rest in peace from the date of the settlement. Accordingly, this civil revision petition is allowed.
