JUDGMENT : - Affidavit-of-service filed be kept with the records. 2. The petitioner having qualification B.Sc with honours in Mathematics and BEd. is eligible for appointment in the post of Assistant Teacher in Mathematics in the concerned School. Petitioner was appointed as an Assistant Teacher in Mathematics in lien vacancy by following the recruitment procedure. Such appointment of the petitioner was approved from 16.9.97 till 1.4.99, however, the said teacher did not turn back and the said post became permanent vacant from 2.4.99. 3. Under the circumstances a Division Bench of this Court was pleased to pass order on 3.3.97 in disposing of M.A. 173/97 directing the authority concerned to grant approval or regularise the service of the appellant/ petitioner in the post which she is holding. I do not think that there is any cause of deviation from the order already passed by the Hon'ble Division Bench of this Court and' having binding effect I dispose of the writ application by directing the District Inspector of Schools (SE), North 24 Parganas to approve the appointment of the petitioner as an Assistant Teacher in Mathematics in the concerned school on permanent basis within two weeks from the date of communication of this order. The District Inspector of Schools (SE), North 24 Parganas is further directed to give such approval with effect from 16.9.97. (Annexure-D) and pay arrear salary from 16.9.97 (Annexure. D page 36) within two weeks from giving such approval and also go on making payment of salary month by month. The order of District Inspector of Schools (S.E.) being Annexure-H stands set aside. The School Authority is restrained from interfering in the service of petitioner. 4. All parties to act on a xeroxed signed copy of this dictated order upon usual undertaking. Amitava Lala, J.
