(1) THE Contempt Petition is dismissed in terms of the signed order. (2) RULE is discharged. (3) SO far as the record of the Contempt Petition is concerned, it shall remain which Original Suit No. 2 of 1997 as there are certain documents which may require reference in O.S. 2 of 1997. I.A. No. 1 in O.S. 1/97 and I.A. Nos. 1, 8 & 9 in O.S. 2/97 (4) OUR attention has been drawn to an order dated 21/07/1998 made in O.S. 1 of 1997 and O.s. 2 of 1997. According to that order, the suits were directed to be listed "before a Constitution bench of five Honble Judges". Since both the Original Suits - one filed by the State of Karnataka and the other filed by the State of Andhra Pradesh - have been referred to the Constitution bench of five Judges, we do not consider it appropriate to deal with I.A. No. I in O.S. I of 1997. I.A. I in O.S. 2 of 1997 or with I.A. Nos. 8 and 9 in O.S. 2 of 1997 sitting as a three-Judge bench. It is appropriate that these I.As. be placed before the Constitution bench which may hear the I.As. itself or desire the same to be heard by a three-Judge bench. (5) LEARNED counsel for the parties submit that matters require an urgent consideration by the Constitution bench. Let these applications - I.A. 1 in O.S. 1 of 1997. I.A. 1 in O.S. 2 of 1997, I.A. Nos. 8 and 9 in O.S. 2 of 1997 he placed before the constitution bench for orders/directions in the week commencing 19/07/1999. The matters be listed before the Constitution bench irrespective of who is presiding over that bench. (6) THE parties are at liberty to complete the pleadings in these applications within four weeks. (7) THE record of Contempt Petition No. 312 of 1998. Which has been dismissed by us by our order of even date shall be kept with the applications before the Constitution bench for reference. (8) TILL the matter comes up before the Constitution bench status quo as existing today with regard to Almatti Dam shall be maintained by the parties.
