JUDGMENT Requirement of security deposit of Rs. 2,000/- is dispensed with in the present case on the recommendation of Registrar and given regard to the importance of the issue raised. Petitioner is a teacher in a slum area school, Jaora. He claims that he one day found 29 out of 50 school children struck by Polio. He thought of investigating the source of the disease and came across a cosspool which harboured filth and affluent from drains and guttors of the surrounding areas and also found that hand-pumps and tube-wells from which water was supplied to the population of locality were located at 10-12 feet's distance. This water was later got tested and found contaminated. Petitioner further asserts that he approached Civil Authorities of Jaora and requested them to take preventive steps but all his efforts went in vain and at one stage his persistent efforts to seek justice for the afflicting children and the authorities resulted in his transfer from the school which was later on stayed by State Administrative Tibunal. He also submits that he had raised this issue by publishing articles in news-papers and by attracting the attention of electronic media but still no efforts were made by authorities to remedy the situation. He accordingly prays that 114 children afflicted so far be provided the requisite medical treatment and paid compensation of Rs. 4,00,000/- per head and that government be also directed to set-up a hospital for their treatment and a centre for their rehabilitation. In view of all this notice is issued to respondents and it is accepted by Shri Vyas, AAG for No. 1, 2 & 5. Special Notice shall issue to respondents No. 3 & 4 and be served through FAX or Telephone by the Registrar requiring them to file their reply to this petition on or before the next date. Meanwhile, Collector Ratlam, present in Court, is directed to visit the slum area in question within two days alongwith Chief Medical Officer and other District Medical Authorities and to have medical examination of all afflicted children conducted and to provide them a requisite medical aid at government expenses.

He shall submit a compliance report on or before next date indicating the nature of the disease that had spread in the area and the number of people hit by it and the measures if any taken, preventive or remedial by the officers/ authorities if so found. In case it is found on medical examination that some of the patients were required to be admitted in hospitals providing specialised treatment, all concerned functionaries of the State shall arrange for their treatment in such hospitals or arrange to pay them an ex gratia relief of Rs. 5,000/- per patient for the present.
