Judgment 1. In this writ petition, grievance of the petitioners, who are widow and son of the deceased Government Servant-Ram Nagina Singh, relates to non-payment of G.P.F. amount. 2. Late Ram Nagina Singh, who was constable in the Department, retired on 1.7.1986 and ultimately died on 12.3.1996, but the G.P.F. amount was neither paid to him nor to his family members after his death. 3. From the counter affidavit filed today, it appears that authority letter contained in Annexure-A for payment of Rs. 4,933/- has been issued by the District Provident Fund Officer, Muzaffarpur to the Superintendent of Police, Muzaffarpur for payment as G.P.F. amount of the deceased Government Servant, after lapse of 13 long years. No plausible explanation has been given in the said counter affidavit filed on behalf of the District Provident Fund Officer, Muzaffarpur-Respondent no.5. it is neither alleged that there was any default on the part of the employee concerned or his family members including the petitioners. 4. Learned counsel for the petitioners submitted that Respondent no.5 has not furnished any detail with respect to the said dues. Under such circumstance it is difficult for the petitioner to ascertain about the correctness of the amount calculated by him. Learned counsel for the petitioner further submitted that in absence of any justifiable reason, petitioners are entitled for payment of heavy interest and cost on account of delayed payment. 5. Having heard learned counsel for the petitioners and the learned counsel for the State and having regard to the aforementioned facts, this Court finds substance in the submission of the learned counsel for the petitioners In the facts and circumstances of the case, District Provident Fund Officer, Muzaffarpur Respondent no.5 should have supplied the details of the account to the petitioners as it is not expected from them to maintain the details of the deductions made from the salary of the deceased Government Servant. Further this Court does not find any plausible explanation for withholding the payment of the G.P.F. dues now for over 13 long years. 6. Under such circumstances, this Court disposes of the writ petition with a direction to Respondent no.5 to furnish the details of the deductions on the basis of which the aforementioned amount of G.P.F. has been determined to the petitioners.

Petitioners will be entitled for penal interest @ 10% per annum besides statutory interest over the amount found payable to the petitioner towards G.P.F. of the deceased Government Servant. The interest will be calculated from the due date till the payment is made as well as the cost of Rs. 5,000/- for which necessary sanction orders shall be issued along with the sanction order for payment of interest by the Superintendent of Police Respondent no.4 within two weeks of the receipt/production of a copy of this order. 7. As prayed on behalf of the State, let a copy of this order be supplied to him for necessary compliance.
