JUDGMENT 1. - Heard. 2. It is alleged that the applicants treated Smt. Saroj with cruelty on account of demand for dowry. Smt. Saroj was married with Dinesh Kumar applicant on 11.6.1998 and died of burn injuries on 10.4.1999. The FIR was lodged by the father of the deceased on 12.4.1999. 3. It was submitted that neither Dinesh Kumar, who is the husband of the deceased, and who is aged about 16-17 years, nor his mother Smt. Santra Devi ever made a demand for dowry from the parents of the deceased. It was further submitted that since the deceased was having some affair with some boy in her village, she did not like her marriage with Dinesh Kumar, applicant, who was younger to her in age. It was further submitted that the deceased committed suicide by sprinkling kerosene oil on her body and that in the course of inquiry under section 174 Cr.P.C. neither of the two applicants was ever doubted to have abated the commission of suicide by her. 4. After having gone through the case diary and the material available between including the post-mortem report, the panchayat nama, the proceedings Under section 174 Cr.P.C. and the statements of the witnesses examined under section 161 Cr.P.C., I direct that the applicants, Dinesh Kumar S/o. Amar Singh and Smt. Santra Devi W/o. Amar Singh, Accused in FIR No. 135/99, P/s. Tijara, Distt. Alwar, shall be released on bail on their furnishing two sureties each in the amount of Rs. 10,000/- each with personal bonds in the amount of Rs. 20,000/- to the satisfaction of the trial court. The personal bond for and on behalf of Dinesh Kumar, applicant, shall be got executed from his natural guardian as it is not clear that Dinesh Kumar, applicant, was or was not a major. *******
