Ghyan Singh v. R. T. A.

1999-07-19

B.J.SHETHNA

body1999
Honble SHETHNA, J.–This is a petition of 1996 filed by the petitioner stating that he is holder of Stage Carriage Permit on Bhadra to Fatiabad via Meharana route. Bus no. RNP 1378 is covered under the said permit. In this case, earlier notice was issued to sole respondent Regional Transport Authority , Bikaner Region, Bikaner. On stay petition, there was an interim order of status quo. (2). This matter was adjourned in past on several occasions for one or the other reason. (3). At the time of hearing, Mr. Maheshwari was asked to show the permit on the basis of which he has filed the petition and prayed for orders. Mr. Maheshwari has prayed for one weekss time for producing the permit. There is no question of granting any time because the law is very settled that the document on which a person wants to rely should be there on record and without that one cannot adjudicate the matter. Permit is always granted for a particular period, it may be for 1,2,3,4,or 5 years. At times the permit might have expired, but under the interim Orders of the court the petitioner will continue to enjoy plying his vehicle, which is not desirable and not permissible under the law. It will be an abuse of process of law. (4). In view of the above, request is rejected and in absence of permit, in my humble opinion, the petition itself is not maintainable. Accordingly, this petition is dismissed without going into the merits of the case. Stay granted earlier stands vacated. Stay petition also stands dismissed.
