JUDGMENT 1. - This state appeal is directed against the judgment dated 23.7.85 passed by the learned Chief Judicial Magistrate, Ist Class, Padampur acquitting the accused respondent Om Prakash of the charge under Section 304-A I.F.C. 2. The prosecution case is that the respondent Om Prakash was driving bus rashly and negligently. Bhanwar Singh a child was standing on the side of the road. The bumper of the bus struck against Bhanwar Singh and his head was crushed by rear wheel of the bus, on account of which. he died. According to the prosecution, there were cattle on the road and as such, the bus could not be at the high speed. The court also found that the head was crushed by rear wheel and as such the driver cannot be held responsible for the death of the child. 3. I have heard learned Public Prosecutor and the learned counsel for the respondent. I have also gone through the record. I have carefully scanned the prosecution evidence. Admittedly, there were cattle on the road end as such the learned Magistrate is right in saying that the bus could not have been with the high speed. It is also not in dispute that the head of Bhanwar Singh was crushed by rear wheel of the vehicle. In view of this, in my view, the order of acquittal does not call for any interference. 4. Consequently, I find no merit in this State appeal, the same is therefore, rejected.State appeal dismissed. *******
