Judgment 1. Heard counsel for the parties. 2. This writ application has been filed for quashing the notification dated 30.6.1999, contained in annexure-3 whereby the petitioner has been transferred from the post of Anchal Adhikari, Madhupur (Deoghar) to the post of Anchal Adhikari, Jamui, as also the order dated 1.9.1999, contained in Annexure 4, whereby he was directed to be relieved from the post. 3. It appears, the petitioner joined at Madhupur in the month of September, 1998 to the post of Anchal Adhikari. On 23.1.1999, as would appear from Annexure-1, he submitted a written report before the Officer-in-charge, Madhupur for starting criminal case against an M.L.A., Shri Hussain Ansari. It further appears that on receipt of the report, the Officer-in-charge registered a case under sections 143, 448, 323 and 584/34 of the Indian Penal Code. 4. Immediately thereafter, as would appear from Annexure-2, Shri Hussain Ansari, M.L.A., wrote a letter to the Commissioner, Santhal Paragna with a request to transfer the petitioner from the post of Anchal Adhikari, Madhupur. He also made certain allegations regarding not proper construction of compound wall or obstruction etc. made by the Anchal Adhikari. 5. The grievance is from the facts noticed above, it would appear that the impugned transfer of the petitioner has taken place purely on a mala-fide ground. 6. I have heard counsel for the petitioner, the State and also perused the material placed on record. In the facts and circumstances stated above, I am satisfied that the impugned transfer of the petitioner has been made purely on a mala-fide ground. 7. I have, therefore, no option but to quash the impugned order and allow the writ application to the extent indicated above.
