JUDGMENT : 1. The quality of fuel has direct relationship with the level of pollution. The Ministry of Petroleum and Natural Gas, in their response to the Environmental Pollution (Prevention and Control) Authority (Bhure Lai Committee) stated that the Ministry would be able to supply diesel and petrol with 0.05% of sulphur content as well as petrol with 1 % Benzene content from 1.4.2000 and 1.10.2000 respectively in NCT, Delhi. 2. After hearing learned counsel for the parties and examining the record, we direct as follows. 3. The Ministry of Petroleum and Natural Gas shall ensure that (1) diesel and petrol with 0.05% sulphur content is made available in NCR (and not only in NCT, Delhi) by 31st May, 2000, (2) Petrol with 1% benzene content is made available in NCR by 1.10.2000. 4. We permit, as agreed to by Bhure Lal Committee, retrofitment of CNG kits for post 1990 autos/TSRs and Taxis. However, all such vehicles shall comply with all other emission norms. The NCT authorities shall permit registration of all such vehicles. 5. From a perusal of the Seventh Progress Report of Bhure Lal Committee, we find that action which was required to be taken to implement the following measures as mentioned in the White Paper on Pollution in Delhi have not so far been taken: (a) Ban on Registration of army disposal vehicles, Govt. auctioned vehicles and commercial goods and passenger vehicles (LCVs) beyond a specified life span. (b) Ban on alteration of vehicles by replacing petrol engines with diesel engines. (Responsibility - Transport Deptt. Time frame - 31.12.1997) 6. It is stated in the Report that the Environment Department had prepared a Cabinet Note which was taken to the Council of Ministers but approval has not so far been received. 7. We direct Mr. Kirit N. Rawal, learned Additional Solicitor General, to ensure that appropriate decisions are taken and orders made by the concerned in regard to the action which was required to be taken in respect of above matters within 8 weeks from the date of this order. 8. List the matter for further directions on 10th May, 2000.
