Judgment :- J.B. Koshy, J. Petitioners belong to Christian religion. They married as per Indian Christian Marriage Act, 1872. Since they want to go abroad they want a certificate from the statutory authority as now church certificate is not being accepted in various foreign countries. They approached the Cochin Corporation for a certificate on the basis of the evidence produced by them regarding the proof of their marriage. It was refused by the Cochin Corporation on the ground that there is no rules enabling the Corporation to give such a certificate. 2. Learned Standing Counsel for the Cochin Corporation Shri. Balakrishnan submitted that under S.8 of the Hindu Marriage Act, Corporation is authorised to give such certificates in the case of Hindu marriages. But with respect to Christian marriage, there is no provision for the Corporation to give such certificates. 3. Learned counsel for the petitioners submits that the Births, Deaths and Marriage Registration Act, 1886 authorises to register all marriages whether it is under Indian Christian Marriage Act or the Parsi Marriage Act. Ss.6, 7, 8 and 9 show how registration should be maintained etc. In fact that shows that Christian Marriages also can be registered but no rules have been framed so far for authorising the Corporation to register the marriage. Now it is not disputed that for the registration under the Hindu Marriage Act Corporations are empowered to register such marriages. It is also submitted by the counsel for the petitioners that if such a provision is not applicable to other religions it is violation of the provisions under Art.14 of the Constitution. In any event under the Births, Deaths and Marriage Registration Act, 1886 other marriages mentioned therein also can be registered. Marriage under the Parsi Marriage Act, Indian Christian Marriage Act etc. can be registered. Since Hindu Marriage Act can be registered an equal status should be given for registration of Christian Marriages also. I direct the Government to make rules expeditiously regarding the same. Meanwhile, the Corporation may give a certificate to the petitioners also on evidence if they are satisfied the genuineness of the marriage, expeditiously. The Original Petition is accordingly disposed of.
