MANMOHAN SARIN ( 1 ) CW. No. 2156 and CM. 4465/97 learned counsel for the petitioner submits that the matter is covered by a decision of the Division Bench in CW. No. 4603/94 dated 24. 11. 1998 and as further clarified in the order dated 12/5/2000 in the said writ petition. Counsel for the parties are agreed that this matter may also be disposed of on the same basis. Petitioner s grievance is that the Assessing Authority of the MCD requires a certificate with regard to the cost of construction for determination of the rateable value. Let individual member of the petitioner society approach the DDA, if required, for purposes of issuance of the said certificate regarding cost of construction. Upon individual member approaching the DDA and supplying the requisite particulars, the DDA would issue certificates containing the bare construction cost of each flat. It would not be necessary for the DDA to give up the break up of the construction cost under various heads. Learned counsel for the petitioner submits that the members/who desire the said certificate would approach the DDA well before time when the certificate is required. It is hoped and expected that the respondent/dda would equally be responsive in issuance of certificate and act in the matter with despatch. Learned counsel submits that wherever necessary its members would seek condonation of delay in filing of the appeals on the ground of their not being in possession of the said certificate, which is to be granted by the DDA pursuant to the order passed in the writ petition. Such an application, if made, would be disposed of by the Assessing Authority in accordance with law. ( 2 ) THE writ petition stands disposed of with the above directions.
