Honble SHAH, J.–Heard the learned Counsel for the petitioner. In our view, the impugned order passed by the High Court does not call for any interference. The special leave petition is dismissed. However, if the petitioner files an application for grant of exemption from personal appearance, the trial Court would grant the same on the conditions the petitioner would not dispute the identity as particular accused in that case; a Counsel on his behalf will be present on such posting dates; and he would make himself available on any date when his presence is needed in that case. Liberty to move the High Court at the appropriate stage. Appeal dismissed.
