Judgment R.H. Zaidi, J. (1) Supplementary affidavit filed by learned Counsel for the petitioner be taken on record. (2) By means of this petition filed under Article 226 of the Constitution of India, petitioner prays for issuance of a writ, order or direction in the nature of mandamus commanding the respondent No. 1 to decide the P.A. Case No. 56 of 1993, Surya Prakash vs. Smt. Bittan Devi and other, at an early date. The grievance of the petitioner is that it was in the year 1993 that an application under Section 21(1)(a) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 (U.P. Act No. XIII of 1972), for short the Act, was filed by the petitioner but till date, the same has not been decided finally in spite of various applications, request and prayers made by the petitioner. (3) The similar controversy as is involved in the present petition, was involved in Writ Petition No. 30893 of 2000, Preetam Singh Kamboo vs. II Additional, District Judge, Dehradun and others connected with Writ Petition No. 30895 of 2000 decided on 19.7.2000. This petition is, therefore, decided in terms of the said decision. (4) The above noted case shall be decided by the Prescribed Authority within two months from the date a certified copy of this order is communicated to the Prescribed Authority, after following the procedure prescribed for the same and after affording opportunity to lead evidence and hearing to the parties. With these observations and directions, this petition stands finally disposed of. Petition disposed of.
