ORDER Heard the parties. In the facts and circumstances, I feel that the matter should be considered by the respondents at first instance. The petitioner appeared in Annual Secondary School Examination, 1996 conducted by Bihar School Examination Board. He was provided with provisional certificate and marksheet. According to petitioner, his date of birth is 10.2.1982 but in the provisional certificate and marksheet, it has been wrongly shown as 10.2.1981. Grievance made that in spite of representation made by him, the wrong date of birth reflected in the provisional certificate/marksheet, has not been corrected. In the facts and circumstances, I remit the matter to the Secretary, Bihar School Examination Board, who will ask the office to verify from the records the date of birth as shown in the admit card; registration certificate; application form as was filled up and sent and other documents. If so necessary, he will correct the date of birth in the provisional certificate/marksheet within 15 days from the date of receipt/production of a copy of this order. If it is found that the date of birth has been correctly reflected, he will simply reject the application and communicate the same to the petitioner within the aforesaid period. The petitioner will produce a copy of this order before the Secretary of the Board alongwith a representation giving details of his examination, including the roll number etc. This writ petition stands disposed of, with the aforesaid observations/directions.
