G.B.PATTANAIK, J. (1) ISSUE notice. (2) MR. V.G. Pragasam accepts notice. (3) THIS is an application against the impugned order and judgment of the High Court of Madras refusing the petitioners prayer to give a certified copy of the taperecorded version of the witnesses that was taken during the course of trial. It is alleged that the copy of the deposition that has been given contains several errors and, therefore, in the interest of justice, the counsel prays that even if the certified copy of the taperecorded version is not given, the evidence that has been given may be compared by some Court Official after playing the cassette in the tape-record. Mr. Natarajan, learned senior counsel appearing for the prosecution has no objection to the same though according to him this is not necessary in view of the orders passed by the learned Judge himself. (4) IN view of this statement of the learned counsel appearing for the prosecution, we think it appropriate to require the learned Judge to get the copy of the evidence given to the accused compared with the cassette which is in the custody of the Court, through an officer and certify to that effect. This may be done within a period of one week from today. (5) THE Special Leave Petition is accordingly disposed of.
