ORDER Bhawani Singh, C.J. 1. This appeal arises out of award of Motor Accident Claims Tribunal, Jabalpur dated 10-2-1998 in Claim Case No. 101/1994. 2. Claimant was going on his bicycle along with pillion rider Ashok Patel on 9-12-1989 from Railway Station Bridge No. 1 to Civil Lines Police Station. When he reached near Bank of India, truck No. 86D-63626 dashed against him. As a result of this accident, Ashok Patel died on the spot and while the appellant suffered grievous injuries. Compensation of Rs. 2,44,800.00 has been claimed but the Tribunal has awarded Rs. 30,000.00. 3. Claimant is not satisfied with the award, therefore, it has been challenged through this appeal seeking enhancement. Learned counsel for claimant submits that meagre amount for 40% disability has been awarded, therefore, it deserves enhancement. Smt. Nair, learned counsel for respondents submits that award is just and reasonable and the appellant has been adequately compensated for the injuries sustained by him, therefore, enhancement is not called for. 4. According to the doctor, petitioner suffered disability to the extent of 40% on account of fracture of clevical bone and injury to the pelvis. These injuries are quite serious and affected the day to day and time to time movement of the appellant. He can not enjoy pleasures of life properly and disability would continue throughout his life. It is pointed out that the petitioner could not join service in Police since he could not be selected for reason that he could not do best to show professional efficiency on account of these injuries. It is also stated that there is difficulty in finding out suitable match for marriage. In this background, we think it would be in the interest of justice to enhance the amount of compensation of 15,000.00 awarded towards disability to Rs. 25,000.00. The amount awarded by the Tribunal under other heads do not require any enhancement. The amount of award shall carry interest at the rate allowed by the Tribunal from the date of application till payment. 5. Appeal is allowed to the extent aforesaid. Costs on parties. 6. Misc. Appeal allowed.
