Judgment S.S.Nijjar, J. 1. The petitioner was married to the deceased on 15.6.2000. She is alleged to have committed suicide on 11.7.2000. The allegations in the FIR are that the marriage was performed with the consent of the family of the deceased. It is also the case of the prosecution that the deceased was, in fact, earlier married in the year 1986 which ended in divorce about 3/4 years ago. Thereafter, the deceased had informed her family that she wanted to marry the petitioner but he belongs to a different caste. It is submitted by the learned counsel for the petitioner that this inter-caste marriage was never accepted by both the families. The death may possibly have occurred due to the matrimonial problem which arose between the petitioner and the deceased. The only allegation with regard to an inducement to commit suicide is to the effect that the deceased was taunted about her previous life. The parents had also threatened to kill the deceased. The members of the family of the petitioner allegedly used to state that the deceased had spoiled the life of the petitioner. 2. During the investigation, the prosecution version with regard to the parents has been disbelieved. Even the statements recorded under Section 161 Cr.P.C. show that members of both the families did not attend the marriage. In fact, Kanyadan was also performed by a friend of the petitioner. Rajnish, another friend of the couple had stated that initially, they were happy with the married life, but later on, differences had surfaced between them. It is possible that for this reason, the deceased ended her life. 3. Prima facie, it appears that it is a case of love marriage gone foul ! At this stage, it is too early to make any comments on the merits of the case put forward either by the prosecution or by the petitioner. However, I am satisfied that this is a fit case where the petitioner to be released on bail. In view of the above, petitioner is allowed bail to the satisfaction of C.J.M., Karnal. Petition allowed.
