Judgment N.C.Khichi, J. 1. Heard. The petitioner, Smt. Balwant Kaur Gill, has come present in this Court after returning from Canada. She obtained the permission from the Court below for going to Canada for medical check up. She was to appear on 12.1.2000. She could not appear for reasons beyond her control. 2. Learned Sessions Judge, Chandigarh, on an application moved on behalf of the petitioner, vide order dated 18.1.2000, directed the petitioner to put in appearance before the trial Court on 25.1.2000 failing which the trial Court was directed to proceed further in accordance with law. 3. This Crl. Revision Petition is directed against the order dated 18.1.2000. It is brought to the notice of this Court by the counsel for the petitioner that nothing happened on 25.1.2000 in the trial Court as the order of the learned Sessions Judge could not reach there. He further stated that consequently the bail bonds were not cancelled and the petitioner was directed to put in appearance on 3.2.2000 by the trial Court. When the matter came up before this Court on 2.2.2000, Mr. Shergil brought to the notice of this Court that the petitioner had boarded a plane and she was likely to land in Delhi on the following day i.e. 3.2.2000. The case was then adjourned for today and the trial Court was directed to adjourn the case to 4.2.2000 without passing any order. 4. After hearing the learned counsel for the parties and considering the peculiar facts and circumstances of the case, this Court is satisfied that the petitioner could not put in appearance uptil 3.2.2000 for reasons beyond her control. This Revision Petition is disposed of. It is directed that the exemption from personal appearance of the petitioner shall be deemed to have been extended uptil today i.e. 4.2.2000. 5. The petitioner undertakes to put in appearance before the trial Court today itself. She further undertakes to appear on each and every date during the pendency of the trial. A copy of the order be given dasti under the signatures of the Special Secretary of this Court.
