JUDGMENT 1. - Heard. 2. This is a petition under Section 482 Criminal Procedure Code against the order of learned Sessions Judge, Udaipur by which he maintained the order of learned Judicial Magistrate No.1 Udaipur by which vehicle was not released. 3. Learned counsel for the petitioner submitted that if the vehicle is not released the same lie at the police station or in the custody of Excise Department where there is no arrangement to keep the vehicle safely and if any loss is caused to the vehicle it will be national loss. He drew my attention to various judgments of this Court in which on this ground alone the vehicles were released on supurdginama. 4. Learned Public Prosecutor has tried to support the order of learned Sessions Judge but looking to all the facts and circumstances the vehicle can be released on some conditions. 5. Consequently, the petition is hereby allowed and it is ordered that vehicle No. RJ-27C-6958 shall be released on supurdginama to the petitioner on furnishing supurdginama of Rs. 5,00,000/- together with a surety of the like amount to the satisfaction of learned trial Judge with the condition that if the vehicle is again found involved in transporting illicit liquor or any contraband or involved in any other criminal case, this order shall stand rejected without reference to this Court. 6. Before releasing the vehicle coloured photographs of the vehicle showing its registration number and chassis number shall be submitted to the prosecution agency as well as to the court concerned at the expenses of the petitioner. The petitioner shall also be bound in supurdginama that he shall not alienate the vehicle to anyone during the trial and will also not change its condition without the previous permission of the court concerned.Petition Allowed. *******
