JUDGMENT 1. - This revision petition is directed against the order dated 17.8.2000 passed by the Civil Judge (J.D.) & Judicial Magistrate, Karauli whereby the application moved by the present petitioner for summoning the witnesses named in the list and relating to the record has been rejected. 2. The witnesses namely Administrator Secretary/Secretary Gram Panchayat Lohra, Manager, Temple Kela Devi/Devi Singh Jain were summoned to bring the original record in regard to the suit of permanent injunction filed by the petitioner plaintiff. 3. Counsel for the petitioner relies on the judgment reported in 1985 RLR 107 , Jagdish Prasad v. Civil Judge, Jaipur . 4. After hearing learned counsel for the parties and in the interest of justice, after perusing the documents, there is no serious objections on the part of the respondent that once opportunity be given to the petitioner for summoning the witnesses at his own expenses and responsibility. The petitioner would be given the assistance of the court for summoning the witnesses for 6.1.2001 on which date the said witness shall be examined. However, if for any reason the witnesses are not examined on that date, the court shall fix the date according to its own convenience. It is made clear that it would be the last opportunity for the petitioner to produce the witnesses. 5. The parties are directed to appear before the court on 6.1.2001. 6. With the abovesaid direction, the revision petition is disposed off.Revision disposed of. *******
