JUDGMENT : 1. This Court issued notice on 1-12-1999 in the following terms: “It is submitted by the learned counsel for the petitioner that Rule 18 of the Punjab Consolidation of Holdings Rules applied to this case and, therefore, application under Section 42 ought to have been made within a period of six months. He further submits that though this point was raised, it has not been considered by the High Court. We, therefore, direct a notice to the issued. Notice to indicate that this matter will be finally disposed of at the notice stage itself.” 2. Now when the matter is taken up for final hearing the learned counsel for the petitioner submits that this ground was not taken in the special leave petition and a perusal of the order of the High Court also does not show that this point was taken before the High Court. Learned counsel for the petitioner submits that this point had been taken in the writ petition before the High Court. We decline to take note of what is stated in the writ petition. In view of this position, we discharge the notice. The special leave petition is dismissed.
