JUDGMENT : 1. Learned counsel for the petitioner requests for permission to withdraw this contempt petition as the petitioner would be advised to resort to other legal remedies in regard to the orders passed by the Government relating to his service. Contempt Petition is accordingly dismissed as withdrawn. It is needless to say that any interim direction or orders passed during the pendency of this petition would stand lapsed. If the petitioner feels that the threat perception is still subsisting at the new place of posting we permit him to approach the authorities concerned for the said purpose. In I.A. No. 5 in W.P. (C) No. 2135/1982 2. Mr. Mahabir Singh, learned Standing Counsel for the State of Haryana reported under instructions that the State would commence the construction of the one room tenements (indicated in the order dated 11.1.2000) within six weeks from today and that the commencement will be followed up by active progress of the work during the following days. We direct Mr. S.P. Singh, Additional District Judge, Faridabad to monitor the said work and sent bi-monthly reports to this Court regarding the progress of the work. As to the possible date of completion of the work Mr. Mahabir Singh, learned counsel requests one more adjournment to get specific instructions to be communicated to this Court. 3. On 16.11.1999 this Court passed the following direction: “Since the Municipal Corporation, Faridabad has already resumed possession over 141 Stone Crtusher (sic) Workers' Housing Plots on 3.4.1998, we direct that dwelling units for these workers shall now be constructed on these plots by the Municipal Corporation, Faridabad with the financial assistance of the State Government. The cost of construction shall be recoverable from the Stone Crusher owners.” 4. So far the said direction has not been carried out though a claim is made that some steps have been taken towards compliance of that direction. According to the State the number of workers in the crushing zone is 225 (who are affected by the demolition of jhugis on 8th September, 2000). Mr. Ranjit Kumar, learned amicus curiae is not in a position to say that the said figure is correct because it requires further scrutiny. We direct Mr. S.P. Singh, Additional District Judge, Faridabad to check Order dated October 18, 2000 in I.A. No. 5 in W.P. (C) No. 2135/1982 with Cont. Pet.
Mr. Ranjit Kumar, learned amicus curiae is not in a position to say that the said figure is correct because it requires further scrutiny. We direct Mr. S.P. Singh, Additional District Judge, Faridabad to check Order dated October 18, 2000 in I.A. No. 5 in W.P. (C) No. 2135/1982 with Cont. Pet. (C) No. 234/2000 in I.A. No. 5 in W.P. No. 2135/1982, up whether the direction issued by this Court dated 16.1 1.1999 has been carried out to any extent. If not, to give appropriate directions as he deems fit to the Commissioner of the Corporation as to the manner in which the said direction as to be impleaded at the spot (sic). For the said purpose he can ascertain the actual number of crushing workers uprooted from the jhugis by reference to the records maintained by the Labour Department and any other relevant materials if he finds it necessary. He must also find out whether any school is working in the stone crushing workers' colony. If not he should give immediate direction to the Commissioner of the Corporation to do whatever is necessary for the functioning of the school in that colony without any loss of time. 5. He must give a report to this Court within 2 months from today on such monitoring carried out by him pursuant to these directions. He will also report as to the mode of transportation if the distance to the school is so much requiring such transportation. We also direct him to report to us as to any interim measure which he deems feasible for rehabilitating the actual workers uprooted from the place where they were living formerly, and we request him to forward that report regarding interim measure as expeditiously as possible. 6.
