ORDER : 1. Heard learned counsel for the appellants. 2. This case is filed as against the judgment which relied on full Bench decision of the High Court by which the Notifications dated 16th December, 1976 and 13th December, 1979 issued under Sections 4 and 6 of the Land Acquisition Act were quashed. At the time of admission, it was pointed out that against the said judgment on which reliance is placed, viz. Civil Appeal No. 3167 of 1983 is pending in this Court. This Court hence issued notice in this matter on 22nd April, 1991 and ordered it to be tagged with Civil Appeal No.3167/83. However, it seems when the other civil appeal was taken up, this case was not placed before this Court and that appeal was dismissed on 4th March, 1987 as learned counsel for the State did not press that appeal. 3. We find the Notifications under Sections 4 and 6, which were subject matter of consideration in the aforesaid appeal is the same as in our case and that having become final as it being quashed, nothing remains for us to decide. Accordingly, the present appeal also fails and is dismissed. We make it clear, we are not entering into the merits and leaving the question of law raised in this appeal open. With the said observation, the present appeal is dismissed. Cost on parties.
