JUDGMENT : K.T. THOMAS, J. 1. We are distressed and dissatisfied with the functioning of the police of Uttar Pradesh vis-a-vis the present case. We directed the Director General of Police (D.I.G.) of the State of U.P. to depute officers to trace out the 2nd respondent who is the under trial prisoner in a murder case. He executed a bond and thereafter escaped. His sureties were called by us and they expressed helplessness in finding him out. The position of the sureties seems to be the same as that of D.I.G. U.P. He and his subordinate H.R. Sharma, Superintendent of Police, Chamoli have filed affidavits and expressed their helplessness to trace out the 2nd respondent. What cannot be appreciated is that these two officers were not able to know even a trace of the 2nd respondent so far, much less finding him out. We propose to pass some remarks about Mr. A.S. Arun, D.G.P. and H.R. Sharma, SP, Chamoli for their inability to know the whereabouts of the said accused. Before we do that we wish to hear them in person. Hence, they are directed to be present in court on the next posting date. 2. Amongst sureties except Vijaypal Singh three are present. Mr. K.B. Sinha, learned senior counsel submits that instructions have been received that the said surety had fallen ill. All the sureties are directed to be present on the next posting date. 3.
