S. R. Lalwani v. Rajasthan State Industrial Development and Investment Corporation Ltd.

2000-12-11

M.JAGANNADHA RAO, Y.K.SABHARWAL

body2000
ORDER : 1. The plea in the review application that the Court indicated that compound interest will be awarded is not correct. The award merely speaks of simple interest. Under normal circumstances, Courts and Arbitrators never grant compound interest in exercise of their discretion. That only rupees five lakhs is being computed was indicated to the petitioner who was present at the hearing of the case. 2. Strictly speaking the Court could have set aside the entire award. But to avoid further litigation, the Court accepted the award of the appellants' Arbitrator and modified it as aforesaid. 3. There is no error in the judgment. The review petition is dismissed.
