JUDGMENT 1. 1. This is Habeas Corpus Petition filed under Article 226 of the Constitution of India. The petitioner states that Meera is his legally wedded wife., but the respondent No. 3 Sumer Singh has detained her in his illegal custody. 2. The state has filed the reply stating that the age of Meera is in between 17 to 18 years. The state has also filed Medical Certificate indicating the age of Smt. Meera in between 17 to 18 years. 3. We have recorded the statement of Sant. Meera in Court. She deposes that she is 18 years of age and she has married with the petitioner Anil Sharma on 28.12.1999 at Delhi. She has disclosed her date of birth as 11.12.1981. She further says that she wants to reside with her husband, the petitioner Anil Sharma. 4. The petitioner has also filed a copy of mark-sheet of Secondary Examination, 1997 of Smt. Meera Bai, in which her date of birth is recorded 15 as 11.12.1981. 5. It is, thus, obvious that on the day of alleged abduction the girt Smt. Meera had attained the age on 18 years. Of course there is Medical Certificate to the effect that the age of the girl is in between 17 to 18 years, but there is always some difference in the age based on Ossification Test. Since Smt. Meera has disclosed her date of birth as 11.12.1981, and the same is recorded in her mark-sheet, she is to be held major. 6. Smt. Meera wants to go along with her husband, the petitioner Anil Sharma. She is major and she is free to go wherever she likes. 7. The police shall take steps for the safety of Smt. Meera till she reaches the house of petitioner Anil Sharma. 8. With the above observations, the Habeas Corpus Petition is disposed of.Petition disposed of. *******
