Judgment K.S.Kumaran, J. 1. Mr. Rajnish Kumar son of Jatinder Lal (2nd respondent) is present in court and is identified by his counsel- Mr. J.B.S. Gill, Advocate. He states that he has no objection for quashing the F.I.R. He also states that he has filed an affidavit in this regard stating that he has no objection for quashing the F.I.R. 2. Heard counsel for the petitioners, State and the 2nd respondent. 3. Learned counsel for the State reports that the State has filed a reply, wherein it has been stated that the chargesheet has been filed in this case. 4. But, taking into consideration that fact that the matter has been settled between the petitioners and the 2nd respondent who is the complainant, and the statement of the 2nd respondent that he has compromised the matter with the petitioners and that he has no objection for quashing the F.I.R. I am of the view that even if the further proceedings are allowed to continue, that will be a sheer waste of time inasmuch as the 2nd respondent- Rajnish Kumar would not support the case of the prosecution. Therefore there is no chance of conviction of the petitioners. Further, it is also in the interest of justice that peace should be allowed to prevail between the parties. Therefore, I am of the view that in view of the statement of the 2nd respondent, the F.I.R. in question can be quashed. 5. The petition is allowed quashing F.I.R. No. 190 dated 27.12.1994 of Police Station City, Hoshiarpur and the other consequential proceedings.
