JUDGMENT 1. - This revision petition is filed against an order dated 28.10.1998 refusing the application of the petitioner filed u/O. 1, R. 10 CPC. 2. The petitioner was plaintiff and he has field a suit based on title seeking injunction against the respondents. The respondents filed a written-statement showing that they have sold the property on 1.7.1998. The suit was filed on 2.7.1998. It was too difficult for the petitioner to implead any one as party to the suit on whom the title was allegedly passed on 1.7.1998. In this back-ground the petitioner has prayed for impleadment of subsequent purchasers as parties to the suit. He has placed reliance on Gouri Spanker v. labbar Singh, 1984 RLW 51. 3. Learned counsel for the respondents agrees that a fresh suit can be filed against the subsequent purchasers. That being the position when the cause is not prohibited under any law then impleadment also cannot be said to be barred. It cannot be said that the suit cannot proceed after impleading the alleged purchasers as parties. 4. In this back-ground, the order impugned in the revision petition does not appear to be based on sound reasoning. 5. In this view of the matter, the revision petition is allowed, the order impugned is set aside. The trial Court should permit the petitioner to implead the alleged purchasers as parties in the suit.Revision allowed. *******
