Judgment G.S.Chaube, J. 1. Heard on the limitation application at flag A as well as stay application at flag B. 2. It is stated that the delay of 34 days in presenting this appeal had occurred primarily due to observance of procedural formalities for obtaining necessary sanction from the higher authorities of the insurance company. Therefore, in the circumstance of the case, the delay is condoned. 3. As regards the stay application, it is stated that out of the amount of compensation of Rs. 1,50,000 the appellant has already deposited Rs. 50,000 with the Tribunal and Rs. 25,000 with this court. The impugned judgment and award discloses that the deceased was a non-earning minor student of IX class and the sole dependent on him, namely, his father was 65 years old. In this view of the matter, the certificate proceeding in Case No. 1 (WC)/ 1999-2000 pending in the court of Mr. S.B. Pathak, Certificate Officer, Dhanbad, shall remain stayed until further orders. Application allowed.
