JUDGMENT 1. - The matter comes up for consideration of stay petition. However, with consent of the parties, the main revision is finally heard. 2. In a suit puportedly for injunction wherein alleging the defendant to be in possession, the plaintiff has filed this application for amendment seeking to add the suit property to have been purchased by the plaintiff by a written document as against the pleading already taken in the plaint about the plaintiff having purchased the property under an oral transaction. This application for amendment has been refused by the impugned order. 3. Without going into the question of genuineness of the document, I have been shown a photo state copy of alleged document which appears to be of Rs. 5/ stamp and purports to convey the property for a sum of Rs. 1,500/-. The document in not a registered one. In such circumstances, the desired amendment cannot be said to be even relevant, much less necessary for determining the Teal question in controversy between the parties. 4. In such circumstances, the application for amendment has rightly been refused by the learned lower Court though on different reasons. However, the net out come is that the revision petition is devoid of any merit and is hereby dismissed. The parties to bear their own costs.Revision dismissed. *******
