Judgment 1. Heard the parties. 2. This is an application for quashing the order dated 12.1.99/1.2.99 of the Special Judge, Deoghar in Special Case No. 5/98, whereby cognizance under section 7 of the E.C. Act has been taken against the petitioners on the allegation that the petitioners were selling Pera, Chura, llaichi Dana at higher rate than the rate which was fixed by the Deoghar Administration. 3. It is not understandable as to how section 7 of the E.C. Act was invoked. Pera, Chura, llaichi Dana do not come under the purview of E.C. Act. I am surprised that the Special Judge, who took cognizance, was so ignorant of the provisions of E.C. Act. 4. This application is allowed and the order of the Special Judge dated 12.1.99/1.2.99 is quashed being illegal and without jurisdiction.
